     Although litigation is often costly and often should be a last resort, in some cases the homeowner may have to file a complaint as the first line of defense.  

     For example, in some states (e.g., Arizona) you must try and seek to obtain an injunction prior to the sale or all of your objection will be forever waived Zubia v. Shapiro, 243 Ariz. 412, 408 P.3d 1248 (2018),

     Bankruptcy is a legal process to help people who owe money, or debtors, get relief from debts they cannot pay and, at the same time, help people who are owed money, or creditors, get paid from assets property the debtor has. 

     After a bankruptcy, the debtor is no longer legally required to pay any debts that are eliminated, or discharged, in bankruptcy court.

     Chapter 7 (a/k/a "Liquidation or Straight Bankruptcy") is the most common form of bankruptcy for individuals. The court sells all your assets (except assets that are exempt) for cash and then pays your creditors. You must make less than a certain amount of money to qualify.

     Chapter 13 (a/k/a the "Wage Earner's Plan") is a repayment plan for individuals with regular income. Under this type of bankruptcy, you pay your debts off over a 3- to 5-year period and you keep your property.

     Since there are different types of bankruptcy, one may be better for you than another, or bankruptcy may not be a good solution for your type of problem at all.  Call us now for a consultation.

     There are approximately 60,000 evictions filed each year countywide.   The stress of an eviction is amplified for those who recently lost their homes through foreclosure.

     Whether your home was sold through a judicial sale or auction, if a real estate investor wins the auction bidding (noteholder), then you might be served with a 'Notice to Quit' on the day of the auction.  That means you could have 3-5 days to move out or be sued.  If you don't move out, the noteholder will sue you in civil court.   If you don't take action, your ability to rent can be harmed.
